Proposed PY2023 Medicare Payment Notice Includes Expansion of Medically Necessary Dental Coverage

On July 7, the Centers for Medicare and Medicaid Services (CMS) released the proposed rule “Medicare and Medicaid Programs: The calendar Year 2023 Payment Policies under the Physician Fee Schedule and Other Changes to Part B Payment Policies, Medicare Shared Savings Program Requirements, etc.” (CMS-1770-P), which sets the reimbursement rates to medical providers for the Medicare program. The proposed rule includes an expansion of dental coverage under Medicare Part B for “medically necessary dental and oral health services,” which are related to transplant procedures or a chronic medical condition.

Massachusetts Court of Justice Upholds Dental Loss Ratio Ballot Initiative Certification

June 29, 2022

On June 15, the Massachusetts Court of Justice upheld the Attorney General’s certification of ballot initiative 21-13, “Initiative Petition for a Law to Implement Medical Loss Ratios for Dental Benefit Plans,” which would establish an 83% loss ratio requirement for dental plans in Massachusetts. The state Legislature will now confirm the ballot initiative and present it to the state’s voters during the Nov. general election.
